Born Integrated Construction

These SMS Terms & Conditions govern the Employee SMS Notification program provided by Born Integrated Construction LLC (“Born Integrated Construction,” “Born,” “we,” “us,” or “our”).

By voluntarily enrolling in the Employee SMS Notification program, you agree to these Terms & Conditions.

1. Program Description

Employees who voluntarily enroll receive non-marketing SMS communications about timekeeping, missed punches, timesheet corrections, approvals, and account notifications. Messages may include:

• Clock-in and clock-out reminders
• Missed time entry notifications
• Timesheet correction notifications
• Timesheet approval updates
• Employee account and workforce management notifications

This SMS program is not used to send advertising or promotional marketing messages. The system also provides one-time SMS verification codes when explicitly requested by employees during authentication.

2. How to Enroll

Employees subscribe to recurring SMS notifications by signing a paper authorization form (available in English and Spanish on our SMS Opt-In page) and confirming enrollment by replying YES (English) or SI (Spanish) to an authorized confirmation message. Recurring notifications begin only after the affirmative reply is received.

3. Voluntary Participation

Recurring SMS enrollment is optional and is not required to use the BIC FieldOps application. Consent is not a condition of employment. Employees who do not enroll may receive applicable information through another available method.

Login Verification

One-time login verification codes are sent only when requested. Requesting a verification code does not automatically subscribe an employee to recurring SMS notifications.

Message Frequency

Message frequency varies depending on employee activity and account events.

4. Message and Data Rates

Message and data rates may apply.

Your mobile carrier's standard messaging, data, and other applicable charges may apply to messages sent or received through this program.

Born Integrated Construction is not responsible for charges imposed by your wireless carrier.

5. Opting Out

You may stop receiving SMS messages from Born Integrated Construction at any time by replying:

STOP

After submitting a STOP request, you will receive a confirmation that you have been unsubscribed. After your opt-out request has been processed, you will no longer receive messages from the Employee SMS Notification program unless you subsequently enroll again.

Recurring notifications will cease following a valid opt-out. Employees who opt out may still receive employment-related information through other appropriate communication methods.

6. Re-Enrolling

If you previously opted out and wish to receive SMS notifications again, you must complete a new signed paper authorization form and confirm by replying YES or SI to a new confirmation message.

8. Supported Carriers and Delivery

SMS message delivery is subject to the availability and operation of participating wireless carriers and telecommunications providers.

Wireless carriers are not responsible for delayed or undelivered messages.

Born Integrated Construction does not guarantee that every SMS message will be delivered or received at a particular time.

9. Employee Responsibility

Employees participating in the program are responsible for:

• Providing an accurate mobile telephone number
• Keeping their mobile number current with Born Integrated Construction
• Maintaining access to the mobile device associated with the enrolled number
• Promptly notifying Born Integrated Construction if their telephone number changes or is reassigned to another person

Employees should not provide a telephone number they do not own or are not authorized to use.

10. Privacy

Born Integrated Construction respects the privacy of employees participating in the SMS program.

Mobile telephone numbers, SMS opt-in information, and messaging consent will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Information may be provided to telecommunications carriers, messaging providers, technology service providers, and other vendors when reasonably necessary to operate and support the Employee SMS Notification program.

11. Changes to the SMS Program

Born Integrated Construction may modify, suspend, or discontinue the Employee SMS Notification program when reasonably necessary.

We may also update these Terms & Conditions from time to time. Updated Terms will be posted on this page with a revised effective date.

Continued participation in the program following an applicable update constitutes acceptance of the updated Terms where permitted by law.
